High Court To Mull Attys' Fees For Time-Barred Vaccine Claims

Law360, New York (November 20, 2012, 5:13 PM EST) -- The U.S. Supreme Court on Tuesday said it would hear the government's appeal of a precedential 7-6 Federal Circuit decision allowing petitioners with time-barred vaccine injury claims to recover attorneys' fees in a special federal program dealing with vaccine-related allegations.

The high court agreed to grant the government's petition, which argued that awarding attorneys' fees to individuals whose compensation petitions fail to meet the Vaccine Act's timeliness requirement “threatens the efficient functioning” of the entire program and fails to properly consider the law's text and structure....
