Fed. Circ. Reinstates Conveyor Maker's Patent Suit

Law360, New York (November 27, 2012, 7:05 PM EST) -- A patent infringement claim Superior Industries LLC brought against rival Thor Global Enterprises Ltd. over support systems for portable conveyors isn't precluded by a previous trademark case, the Federal Circuit said Tuesday in reviving Superior's suit against Thor.

A three-judge panel held in a 2-1 ruling that a successful suit Superior filed in 2009 accusing Thor of infringing Superior's “FB” mark for conveyors and undercarriage assemblies didn't bar Superior from alleging infringement of a related undercarriage system that supports conveyor assemblies, nixing a lower court's conclusion...
