Gas Co.'s Bid For Market-Based Rates Rejected By DC Circ.

Law360, New York (November 27, 2012, 3:58 PM EST) -- The D.C. Circuit on Tuesday upheld the Federal Energy Regulatory Commission’s denial of Northern Natural Gas Co.’s request to charge gas shippers market-based rates at an Iowa facility, saying those rates should be used only as incentives at new facilities.

Northern had been allowed to charge market-based rates, as opposed to the usual cost-based rates, when it opened the Iowa facility in 2006 as an incentive to get the operation up and running. Then in 2010, it requested permission to continue to charge market-based rates when...
