DC Circ. Tosses NLRB Ruling That Brush Co. Snubbed Union

Law360, New York (November 27, 2012, 6:46 PM EST) -- The D.C. Circuit on Tuesday overturned a ruling by National Labor Relations Board that a Chicago brush manufacturer violated federal labor law by refusing to negotiate with its union, ruling that the two sides had reached a legitimate impasse.

Erie Brush & Manufacturing Corp. wasn't legally required to keep bargaining with Service Employees International Union after talks broke down on key issues, the appeals court said. The ruling reversed the labor board's decision that management broke off meetings prematurely, eventually prompting the dissolution of the union....
