Alaska Governor Immune To EEOC Lawsuit: Court

Law360, New York (November 8, 2007, 12:00 AM EST) -- The Eleventh Amendment to the U.S. Constitution bars the Equal Employment Opportunities Commission from taking legal action against the governor of Alaska on behalf of two state employees, an appeals court has found.

Ruling on the Alaska Governor's Office's appeal of an EEOC sexual harassment lawsuit on behalf of two female employees, the U.S. Court of Appeals for the Ninth Circuit on Thursday found that a governor's policymaking assistants are not subject to the federal Government Employee Rights Act.
