Settling Vioxx Claims Wasn't An About-Face: Merck

Law360, New York (November 9, 2007, 12:00 AM EST) -- While Merck & Co., Inc. has long held that it would fight each lawsuit alleging its painkiller Vioxx caused serious health problems individually, it said the $4.85 billion settlement it agreed to Friday is not a change from – but a product of – its defense strategy.

The company said it decided to settle because the statute of limitations has closed in most jurisdictions and that it experienced some success with the cases that were taken to trial, which put it in an advantageous negotiation position....
