Bag Co. Can't Dodge Irish Utility's Cartel Claims

Law360, New York (November 28, 2012, 7:39 PM EST) -- A U.K. court refused Wednesday to nix price-fixing damages claims that Irish utility service provider Bord na Mona PLC brought against a British industrial bag manufacturer that alerted European Union authorities to the cartel.

Justice Julian Flaux refused British Polythene Industries PLC's motion to strike Bord na Mona's claims. The High Court judge reasoned that even though the 2005 European Commission decision penalizing the cartel members did not target price-fixing in the U.K. and Ireland, Bord na Mona could still provide evidence beyond what the EC...
