8th Circ. Shields Holding Co. From ACA Contraceptive Rule

Law360, New York (November 29, 2012, 2:50 PM EST) -- The Eighth Circuit on Wednesday granted O'Brien Industrial Holdings LLC’s bid to temporarily halt the Affordable Care Act’s contraception mandate from applying to the company until its appeal over whether the mandate violates its owner’s religious freedom is decided.

In an order made without comment, the circuit court panel granted a preliminary injunction to St. Louis-based holding company O’Brien and its owner, Frank O'Brien Jr. The move prevents the U.S. Department of Health and Human Services from enforcing the ACA’s preventative care provision against the business until...
