EPA Settles With Energy Co. Over W.Va. Wetlands Violations

Law360, New York (November 30, 2012, 2:38 PM EST) -- The U.S. Environmental Protection Agency said Thursday that PDC Mountaineer LLC has agreed to pay $177,500 to settle claims its construction activities at the Marcellus Shale gas extraction facilities in West Virginia destroyed wetlands and streams.

In addition to the fine, PDC Mountaineer has agreed to restore or complete mitigation projects at four sites to settle claims it improperly filled nearly an acre of wetlands or relocated and placed culverts in streams without first getting a Section 404 permit from the U.S. Army Corps of Engineers,...
