Fed. Circ. Revives ArcelorMittal Patent In Infringement Suit

Law360, New York (November 30, 2012, 8:59 PM EST) -- The Federal Circuit on Friday overturned a jury verdict invalidating an ArcelorMittal SA patent on steel used in car making and ordered a new trial over its claims against AK Steel Corp.

A three-judge panel said a new trial was necessary because an error in the district court's claim construction precluded the jury from considering evidence related to the commercial success of ArcelorMittal's cold-rolled commercial steel products.
