RI Health Workers Sue To Block State's Flu Shot Mandate

Law360, New York (December 7, 2012, 4:22 PM EST) -- Rhode Island health care workers on Thursday sued the state for requiring them to get flu shots or wear surgical masks, saying the mandate is unlikely to protect patients, runs afoul of collective bargaining rights and infringes federal privacy law.

The SEIU Healthcare Employees Union’s lawsuit, filed the same day that the Rhode Island Department of Health triggered the requirement by declaring a flu outbreak, argues there is no clinical data to show that vaccinating medical personnel lowers infection rates among patients.
