Trustee Objects To Dura's Ch. 11 Plan

Law360, New York (November 13, 2007, 12:00 AM EST) -- With less than a month to go before its plan confirmation hearing, the U.S. trustee overseeing Dura Automotive Inc.'s Chapter 11 proceedings has objected to the company's blueprint for exiting bankruptcy, arguing that the plan contains overly broad release provisions and gives short shrift to certain creditors.

U.S. Trustee Kelly Beaudin Stapleton lodged the objection Monday, telling the Delaware Bankruptcy Court that Dura's restructuring plan shouldn't be confirmed because it unfairly discriminates against certain general unsecured creditors and contains impermissible release and exculpation provisions.
