1st Circ. Won't Rehear Meat Co.'s Case Over E. Coli Outbreak

Law360, New York (December 14, 2012, 4:21 PM EST) -- The First Circuit on Friday refused to rehear Greater Omaha Packaging Co. Inc.'s challenge to a unanimous verdict finding it responsible for a 2009 E. coli outbreak, following the appeals court's November decision finding sufficient evidence that the company shipped tainted meat.

GOPAC had argued that the appeals court “overlooked or misapprehended several dispositive undisputed material facts” in its November opinion upholding the verdict, but the Fifth Circuit denied the company's petition in a one-sentence order.
