Momentive Gets Partial Win In Brazil Spill Coverage Suit

Law360, Los Angeles (December 18, 2012, 7:56 PM EST) -- An Ohio federal judge on Tuesday refused to clear insurance broker Willis North American Inc. of claims it misled Momentive Specialty Chemical Inc. about its handling of coverage for a 2004 oil spill off the coast of Brazil.

Senior U.S. District Judge James L. Graham of the Southern District of Ohio held that Momentive Specialty Chemicals Inc. could allege that it relied on assurances that Willis had alerted Chartis Specialty Insurance Co. to the spill and the chemical company's coming insurance claim.
