Ex-S&N Reps Barred From Client Contact In $56M Secrets Row

Law360, New York (December 19, 2012, 1:20 PM EST) -- A Tennessee federal judge on Tuesday barred several former Smith & Nephew Inc. sales contractors from contacting the medical device maker's clients for rival companies, saying S&N has a good chance of winning its $56 million trade secrets case against the contractors.

U.S. District Judge Jon Phipps McCalla ordered five Northwest Ortho Plus Inc. employees not to contact more than 100 S&N clients until the parties complete arbitration in the case, upholding an S&N noncompete clause built into the sales representatives' contracts.
