Juror Replacements Must Be On Record, Pa. High Court Says

Law360, New York (December 19, 2012, 1:27 PM EST) -- The Pennsylvania Supreme Court ruled Tuesday that jurors can only be removed by a trial court, on the record, with notice to the parties and for cause, granting a new trial to a man that claimed Frankford Hospital of Philadelphia was responsible for his wife's post-surgery death.

The high court reversed a 2010 decision by the Pennsylvania Superior Court which held that the replacement of a juror after the trial in Thomas Bruckshaw's medical malpractice suit against the hospital and two doctors was a harmless error...
