NLRB Flouted Quorum Rule, Chamber Tells DC Circ.

Law360, New York (January 2, 2013, 7:06 PM EST) -- The U.S. Chamber of Commerce told the D.C. Circuit on Monday that the National Labor Relations Board flouted its quorum requirement when it passed a rule aimed at speeding up union elections with only two members present.

The Chamber filed a brief urging the appeals court to affirm U.S. District Judge James Boasberg's May 14 decision that the rule, which would also curtail employers' involvement in determining union representation, was unconstitutional because only two NLRB board members were present when the measure was voted on....
