RI Judge Finds Aredia Suit Against Novartis Time-Barred

Law360, New York (December 21, 2012, 4:35 PM EST) -- A Rhode Island federal judge ruled Wednesday that a Massachusetts statute of limitations barred a suit against Novartis Pharmaceuticals Corp. claiming the bone drug Aredia caused a woman's jaw condition, saying she refused to apply a novel tolling theory to another state's law.

U.S. District Judge Mary Lisi adopted the recommendations of a magistrate judge, who said in August that Novartis should be granted summary judgment. Plaintiff Wayne Patterson claimed his now-deceased wife Margaret took Aredia from 2000 to 2006 to treat her osteoporosis and developed...
