Watchdog Blasts 5-Hour Energy Maker Over 'Crash' Claim

Law360, New York (January 3, 2013, 7:16 PM EST) -- The maker of 5-Hour Energy falsely asserts that an advertising industry self-regulator backed its claim that the product does not cause a reduction or "crash" in energy levels, the National Advertising Division said Thursday, adding it will launch a review that could lead to government action.

The NAD, a unit of the Council of Better Business Bureaus that reviews advertising for accuracy, found in 2007 that consumption of Living Essentials LLC's so-called energy shots did not result in "no crash later," as the company claims. The...
