8th Circ. Affirms General Mills' $2.2M Win In Meatball Row

Law360, New York (January 7, 2013, 4:26 PM EST) -- The Eighth Circuit on Monday affirmed a $2.2 million win for General Mills Operations LLC in its contractual fight with meat supplier Five Star Custom Foods Ltd. over a 2008 recall of beef used to make meatballs in Progresso soup.

The appeals court shot down Five Star’s argument that a U.S. Department of Agriculture press release about adulterated beef that General Mills relied on when it decided to destroy the affected soup supplies is inadmissible hearsay, determining that while the release did constitute hearsay, it also...
