ITC Nixes Invisalign IP Enforcement Action

Law360, New York (January 7, 2013, 7:36 PM EST) -- The U.S. International Trade Commission on Friday rejected claims by Align Technology Inc., maker of the Invisalign teeth-straightening system, that a rival company had breached a previous patent settlement over the popular clear braces.

The commission's decision terminated an investigation into whether Houston-based ClearCorrect Operating LLC broke a 2006 promise not to import the braces, which are protected by two U.S. patents held by Align.
