Innolux Asks Fed. Circ. To Nix Enhanced Mondis Royalties

Law360, Washington (January 8, 2013, 7:40 PM EST) -- Chimei Innolux Corp. urged a Federal Circuit panel on Tuesday to overturn the enhanced royalty payments it has to pay Mondis Technology Ltd. for infringing the company's computer monitor patents, saying a judge shouldn't have inflated the award based on potential willful infringement in the future.

According to Innolux, a Texas federal judge abused his discretion when he awarded Mondis a 1.5 percent ongoing royalty rate despite a jury initially mandating royalties of 0.5 percent for computer monitors and 0.75 percent for televisions. While the judge...
