Hospital Supply Antitrust Suit Flatlines On Appeal

Law360, New York (November 20, 2007, 12:00 AM EST) -- An appellate court has refused to resuscitate a medical supplier’s antitrust suit against a wide range of companies, including Novation LLC, U.S. Bancorp NA and Neoforma Inc., for an alleged conspiracy to shut other companies out of the hospital supply market.

The U.S. Court of Appeals for the Tenth Circuit on Friday dismissed Medical Supply Chain Inc.’s appeal of a lower court’s decision because the appeal was filed too late. The decision, which was made without oral argument, said that the appeal was filed on Sept....
