Brand-Name Makers Can Face Generic-Drug Suits: Ala. Court

Law360, New York (January 11, 2013, 5:08 PM EST) -- The Alabama Supreme Court ruled Friday that makers of brand-name drugs can be held liable for injuries caused by their generic counterparts in some circumstances, defying other courts across the country that have held otherwise.

Under Alabama law, consumers allegedly injured by a generic drug can bring suit against the corresponding brand-name manufacturer for fraud or misrepresentation based on statements it made about the brand-name drug, such as those on a warning label, the high court held.
