Law360, New York (January 29, 2013, 12:53 PM EST) -- On March 16, 2013, the “first inventor to file” (FITF) provisions of the America Invents Act go into effect and the United States patent system will transition from a “first to invent” system to a FITF system. This means that in most instances, if two inventors separately file patent applications on the same invention, then the patent will go to the inventor who filed the first patent application.
