Miss. Gov. Can't Block Health Insurance Exchange, AG Says

Law360, New York (January 16, 2013, 5:33 PM EST) -- Mississippi's insurance commissioner has the legal authority to unilaterally implement a health insurance exchange over the objections of the state's governor, the state Attorney General's Office said Tuesday.

According to the attorney general's opinion, a 2009 amendment to a clause in a state health insurance law — the Comprehensive Health Insurance Risk Pool Association Act — had given Commissioner Mike Chaney the authority to establish a method for people in the state to obtain or keep health insurance coverage under any related state or federal program,...
