DuPont Secures Permission For CERCLA Suit

Law360 (November 26, 2007, 12:00 AM EST) -- E.I. DuPont Nemours & Co. has won an expected victory, with an appellate court reversing itself in light of a recent U.S. Supreme Court decision and ruling that attempts to make the federal government pay for cleanups of jointly contaminated waste sites are permissible.

A three-judge panel of the U.S. Court of Appeals for the Third Circuit unanimously overturned its earlier decision on Nov. 20.
