Ex-McDermott Atty Fed Client IP To Family Co., Suit Says

Law360, New York (January 23, 2013, 1:35 PM EST) -- McDermott Will & Emery LLP failed to prevent an intellectual property lawyer from passing a client’s trade secrets to his family’s health care business, helping it acquire an undeserved patent, according to a malpractice suit removed Tuesday to Washington federal court.

Palo Alto, Calif.-based Theranos Inc. claims in the Dec. 29 suit that McDermott hired patent attorney John Fuisz, who is no longer with the firm, despite a lawsuit from the early 1990s that accused Fuisz of improperly accessing another legal client’s private information. McDermott must...
