Glenmark Sues GSK To Invalidate Antibiotic Cream Patents

Law360, New York (January 25, 2013, 4:04 PM EST) -- Indian drugmaker Glenmark Generics Ltd. on Thursday sued British pharmaceutical giant GlaxoSmithKline PLC in Delaware federal court in hopes of invalidating patents for antibiotic cream Bactroban and clearing the way for sales of a generic equivalent.

The suit, filed the same day Glenmark won U.S. Food and Drug Administration approval to market its competing ointment, accuses GSK of missing a 2008 deadline to list its Bactroban patents in the FDA’s Orange Book, a list of approved drugs.
