Okla. Says ACA Tax Credits Jeopardize Its Sovereignty

Law360, Washington (January 28, 2013, 1:51 PM EST) -- Oklahoma on Friday blasted the federal government's attempt to derail its Affordable Care Act challenge, saying it's protecting its own sovereign rights rather than its residents' by contesting federal subsidies for health insurance premiums purchased via state-based exchanges and not their federal counterparts.

While the ACA gives states the choice to create their own health insurance exchanges or participate in a federally facilitated exchange, Oklahoma alleges that the Internal Revenue Service eliminated that choice when it promulgated a rule providing federal tax credits to help residents...
