USPTO Rejects Apple's Bid For 'EarPod' Trademark

Law360, New York (January 28, 2013, 2:40 PM EST) -- The U.S. Patent and Trademark Office on Friday rejected Apple Inc.'s bid for a trademark on the term "EarPods," finding that it is merely descriptive of the headphones used for Apple's iPhone.

Apple applied for a trademark on the term in October, saying that it planned to use it on headphones and microphones used with video players and mobile phones.

In Friday's letter of refusal, the USPTO said that "EarPod" simply describes a pod-shaped headphone that can be inserted into the ear and that other companies...
