Generic Medical Foods Not Identical To Pamlab's, Suits Say

Law360, New York (January 29, 2013, 2:49 PM EST) -- Pamlab LLC on Monday filed false advertising complaints in Washington state and Louisiana accusing Viva Pharmaceutical Inc. and Macoven Pharmaceuticals LLC of selling generic versions of medical foods without ensuring the specialty vitamin treatments are identical to brand-name counterparts.

The federal lawsuits, which were joined by Pamlab’s authorized generics maker, Breckenridge Pharmaceutical Inc., allege that Canada-based Viva and Texas-based Macoven promoted their products as substitutes for branded medical foods despite lacking proof the active ingredients were the same.
