Zinc Evidence Belongs In P&G Fixodent Case, 11th Circ. Told

Law360, New York (January 29, 2013, 8:05 PM EST) -- Expert testimony was unfairly excluded from a suit in multidistrict litigation over Procter & Gamble Manufacturing Co. dental cream, even though it would have presented well-accepted medical conclusions, a consumer blaming the cream for her neurological damage told the Eleventh Circuit on Monday.

Marianne Chapman and her husband claim the lower court failed to follow the standard established by the U.S. Supreme Court's 1993 decision in Daubert v. Merrell Dow Pharmaceuticals Inc., which prevented testimony from epidemiology, toxicology and neurology specialists.
