Judge Nixes Antitrust Claims Against Dow

Law360, New York (November 29, 2007, 12:00 AM EST) -- A federal judge has upheld a claim that Dow Chemical Co. abused its knowledge of Foam Supplies Inc.'s trade secrets but tossed the remainder of FSI's antitrust claims, saying Dow does not have a monopoly in the relevant market.

On Tuesday, Judge Catherine D. Perry of the U.S. District Court for the Eastern District of Missouri denied Dow's motion to dismiss FSI's breach of a confidentiality agreement claim, but granted Dow's motion for summary judgment on all antitrust claims, dismissing them with prejudice.
