Permanent Injunctions In eBay Patent Case Threaten Free Speech, Consumer Activists Say

Law360, New York (September 26, 2005, 12:00 AM EDT) -- In a new development in the patent dispute between eBay and MercExchange, the Electronic Frontier Foundation has filed a “friend-of-the-court” brief with the U.S. Supreme Court asking the court to review the case and arguing that automatic injunctions are a threat to free speech.

The EEF, a non-profit organization that seeks to protect consumers’ digital rights, contends that a U.S. Federal Circuit Court of Appeals ruling against eBay earlier in the year that applied a permanent injunction is a threat to free expression online. The group...
