Merck Claims Ky. AG Knows Nothing About Vioxx Prosecution

Law360, Washington (February 1, 2013, 7:51 PM EST) -- Merck Sharp & Dohme Corp. urged a Kentucky federal judge on Thursday to block the state's attorney general from using outside counsel to prosecute state court cases, claiming the office lacks any control or knowledge of the most basic facts of its case against the drugmaker over alleged deceptive promotion of its drug Vioxx.

While the attorney generals can hire outside counsel on a contingent-fee basis if it retains complete control over the case, Merck told the court that the “most knowledgeable attorney” in the office...
