Samsung Says Ericsson Misbehaved In Filing ITC Complaint

Law360, New York (February 5, 2013, 2:44 PM EST) -- Samsung Electronics Co. Ltd. urged the U.S. International Trade Commission on Monday to block Ericsson Inc. from amending a complaint against Samsung to include a newly reissued cellphone patent, saying Ericsson's complaint was filed in bad faith.

According to Samsung, Ericsson sought the reissue because it knew that one of the patents in its complaint against Samsung patent was invalid in view of the prior art. That patent should therefore never have been included in the complaint, and Ericsson should now be barred from replacing it...
