Fifth Circuit Revives Suit By Kimberly-Clark Workers

Law360 (November 30, 2007, 12:00 AM EST) -- An appeals court has revived a lawsuit for unpaid severance pay filed by dozens of workers against retail goods manufacturer Kimberly-Clark Corp., but has refused the employees' request to return the case to state court.

In an order filed Thursday, the U.S. Court of Appeals for the Fifth Circuit overturned a federal judge's dismissal of the suit by 59 former employees, who allege their employer wrongfully denied them their dues when the company laid them off in December 2004.
