Court Tosses DOJ's Stolt-Nielsen Indictment

Law360, New York (November 30, 2007, 12:00 AM EST) -- Shipping company Stolt-Nielsen SA has won the latest battle in its war with the U.S. Department of Justice over alleged antitrust violations, after a district court threw out the federal indictment handed down against the company and two of its executives.

In a decision handed down on Friday, Judge Bruce W. Kauffman of the U.S. District Court for the Eastern District of Pennsylvania threw out an indictment that charged Stolt with bid-rigging, despite the fact that the company had entered a non-prosecution agreement with the government....
