Facebook Vacation Pics Scuttle FMLA Suit

Law360, New York (February 8, 2013, 3:42 PM EST) -- A Michigan federal judge on Tuesday nixed a nurse's suit claiming Detroit Medical Center fired her for taking medical leave, finding that the hospital believed the employee was abusing her leave because she lied when confronted about vacation photos she posted to Facebook.

U.S. District Judge Lawrence P. Zatkoff granted summary judgment to Detroit Medical Center, dismissing former employee Carol Lineberry's lawsuit accusing the hospital of interfering with her Family and Medical Leave Act rights and retaliated against her for taking legally protected leave.
