Cabot Can't Nix Appeal Of Fracking Pollution Settlement

Law360, Philadelphia (February 11, 2013, 4:58 PM EST) -- A Pennsylvania judge on Friday denied Cabot Oil & Gas Corp.'s bid to dismiss homeowners' appeal of a settlement between the company and the state Department of Environmental Protection stemming from alleged contamination of their drinking water from natural gas drilling.

Environmental Hearing Board Judge Bernard Labuskes found that the acceptance of escrow payments from Cabot as third-party beneficiaries of the agreement did not preclude four residents from the town of Dimock in northeastern Pennsylvania from challenging the settlement.
