Fed. Circ. Backs AstraZeneca Win In Seroquel XR Patent Row

Law360, New York (February 14, 2013, 11:28 PM EST) -- The Federal Circuit on Thursday affirmed a lower court’s ruling that AstraZeneca PLC’s patent for the anti-psychotic drug Seroquel XR was infringed by four generics makers.

A three-judge panel affirmed the March ruling by New Jersey U.S. District Judge Joel Pisano without explaining their decision for doing so. In the March ruling, Judge Pisano found that generics makers Mylan Inc., Torrent Pharmaceuticals Ltd., Anchen Pharmaceuticals Inc. and Osmotica Pharmaceutical Corp. had infringed on AstraZeneca’s patent when they filed for abbreviated new drug applications with the U.S....
