Judge Denies J&J Request to Bar Boston Scientific's Taxus

Law360, New York (November 22, 2003, 12:00 AM EST) -- Judge Sue Robinson of the U.S. District Court in Delaware on Friday denied Johnson & Johnson's Cordis unit an injunction to keep Boston Scientific Corp.'s Taxus drug-eluting stent off the market.

Judge Robinson ruled that Cordis would not suffer irreparable harm if Taxus entered the marketplace pending the outcome of the trial. In addition, the court found that Boston Scientific would suffer irreparable harm and that the public interest favored competition among medical device manufacturers.
