Judge Blocks Quick Win In NC Superfund Test Case

Law360, New York (February 19, 2013, 5:13 PM EST) -- A North Carolina court on Monday denied cross-motions for summary judgment on claims against Broad River Electric Cooperative Inc., an important test case in sprawling litigation over PCB cleanup at the Superfund site of an abandoned electrical transformer repair facility.

Judge Louise W. Flanagan of the North Carolina Eastern District rejected the motions after finding that the case at issue revolves around a question of whether transformers owned by Broad River were drained of harmful PCBs at the time they were sent in for repairs. The...
