Troutman Dodges $40M Malpractice Suit Over Mariner Merger

Law360, New York (February 20, 2013, 2:56 PM EST) -- A New York federal judge on Wednesday killed a malpractice and fraud suit accusing Troutman Sanders LLP of helping a real estate mogul bilk $40 million from former client Mariner Health Care Inc.'s $1.3 billion merger, saying her court lacks jurisdiction.

In her ruling, U.S. District Judge Ronnie Abrams dismissed the suit without prejudice after determining that the allegations leveled in Mariner's filing fell outside her court's parameters, siding with the argument Troutman submitted in a sharply worded motion to dismiss a month before.
