Pa. Judge Upholds Philly Ban On Cops' Political Donations

Law360, New York (February 22, 2013, 7:12 PM EST) -- A Pennsylvania federal judge ruled Thursday that a provision of the Philadelphia Home Rule Charter banning members of the Philadelphia Police Department from making political contributions is constitutional, saying public interests trump police officers’ freedom of political expression.

U.S. District Judge Juan R. Sanchez declined to grant the officers’ motion for summary judgment and upheld the city’s ban, saying it justifiably deters a real and well-documented threat to the operation of city government and outweighs the police officers’ narrow First Amendment interests.
