Fed. Circ. Urged To Restart Volkswagen Engine IP Suit

Law360, Washington (March 8, 2013, 3:33 PM EST) -- Kruse Technology Partnership pushed a Federal Circuit panel on Friday to revive its internal combustion engine patent infringement dispute against Volkswagen AG, claiming a California federal court inappropriately narrowed its patent claims and hampered their case by refusing to allow the company to amend its claims.

According to Kruse, a California federal judge determined the patents-in-suit covered internal combustion engines that have a constant temperature throughout combustion process, which even Volkswagen admitted during Friday's oral arguments is an impossible task.
