Judge Stands By Ruling For Wyeth In Prempro Case

Law360, New York (December 7, 2007, 12:00 AM EST) -- A Pennsylvania judge who overturned a verdict against Wyeth Pharmaceuticals Inc. over its controversial hormone treatment has called on an appeals court to uphold his judgment, issuing a long-awaited opinion applauded by the drug maker Friday.

The Philadelphia Court of Common Pleas judge, Ricardo C. Jackson Jr., told the intermediate appellate court that the plaintiff in the case had presented insufficient evidence that Wyeth's alleged failure to adequately warn of the breast cancer risks linked to Prempro would have influenced the woman's treating physician, who prescribed...
