1st Circ. Scraps Mass. Challenge To Nuke Plant License

Law360, New York (February 25, 2013, 7:27 PM EST) -- The First Circuit on Monday nixed Massachusetts' appeal of the U.S. Nuclear Regulatory Commission's relicensing of the state's sole nuclear power plant, saying the regulator had adequately considered the state's safety concerns over the plant following Japan's Fukushima Daiichi nuclear disaster.

Massachusetts Attorney General Martha Coakley's petition claimed the NRC abused its discretion in granting a new 20-year license to Entergy Nuclear Operations Inc.'s Pilgrim Nuclear Generating Station, a 688-megawatt plant in Plymouth, Mass., in May.
