High Court To Weigh In On Wal-Mart Disability Case

Law360, New York (December 7, 2007, 12:00 AM EST) -- The U.S. Supreme Court agreed Friday to hear an appeal of a lawsuit alleging Wal-Mart Stores Inc. was wrong when it filled a vacant position with the most qualified person instead of giving it to a person it already employed who had become disabled.

Appeals courts have been split on the issue, court documents and an attorney said, and in this case the U.S. Court of Appeals for the Eighth Circuit ruled for Wal-Mart.
